Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the QuickManager website at quickmanager.ma, the QuickManager dashboard, APIs, and related services (together, the “Service”) offered by NETCODE (“we”, “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

QuickManager is a cloud ERP for inventory, sales, accounting, and related operations. Features, limits, and availability may vary by plan or organization, including usage caps that may apply to metrics such as records, team seats, API use, or other measures described in your order or in-product plan details. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable, or immediately where required for security, legal compliance, or abuse prevention.

2. Eligibility and accounts

You must have authority to bind your organization if you register on its behalf. You are responsible for safeguarding credentials, for activity under your account, and for keeping account information accurate. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to misuse the Service. Without limitation, you must not:

  • Violate applicable law or third-party rights.
  • Send spam, malware, or deceptive content; or use the Service to harass, defraud, or harm others.
  • Attempt to probe, scan, or breach security, or interfere with the Service or other users’ use of it.
  • Reverse engineer or circumvent technical limits except where applicable law expressly permits.
  • Resell or redistribute the Service in violation of your agreement or our written permission.

4. Customer data and privacy

You retain rights to content and data you submit, subject to the rights we need to operate the Service. Our Privacy Policy describes how we handle personal data. Where you process personal data about customers, suppliers, or other parties in your business operations through QuickManager, you are responsible for lawful bases, notices, and agreements as required by applicable law.

5. Intellectual property

We and our licensors own the Service, including software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription or trial in line with these Terms. Feedback you provide may be used by us without obligation to you.

6. Third-party services

Integrations (e.g. CRM, accounting, MLS or portal providers, e-signature tools) are subject to their own terms. We are not responsible for third-party services you connect or for outages outside our reasonable control.

7. Disclaimers

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed. We do not guarantee uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by applicable law, NETCODE and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from or related to the Service. Our aggregate liability for claims arising out of or related to the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or, if none, one hundred (100) USD). Nothing in these Terms limits liability that cannot be limited under mandatory law.

9. Indemnity

You will defend and indemnify NETCODE and its officers, directors, and employees against third-party claims, damages, and costs (including reasonable attorneys’ fees) arising from your use of the Service, your data or content, or your breach of these Terms, to the extent permitted by law.

10. Suspension and termination

We may suspend or terminate access for material breach, risk to the Service or others, or legal requirement. You may stop using the Service at any time. Provisions that by nature should survive (e.g. liability limits, indemnity, intellectual property) survive termination.

11. Governing law and disputes

These Terms are governed by the laws of Morocco, without regard to conflict-of-law rules. Courts located in Morocco have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to any mandatory rights you may have under the law of your country of residence.

12. Changes

We may update these Terms by posting a revised version on this site and updating the “Last updated” date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
